1. Calculating the Level of Residence Allowance

The level of allowance payable in individual cases is determined by Luton Borough Council having taken into account the needs and resources of the child and the applicants circumstances. Current needs and future projected requirements are equally considered. The following special factors are therefore taken into account:

  1. Financial resources available to the applicants
  2. The amount needed by the applicants
  3. The financial needs and the resources of the child

An assessment form is forwarded to the applicants, annually to ascertain (a) or (b).

1.1 Financial Resources Available to the Applicants

The assessment form requests information on the applicants financial resources and income from capital investments. The value of the applicants home is not included. Details are also required of any financial benefits. Any mobility or attendance allowance that the child receives (or subsequently becomes entitled to) will not be included as a source of income. The payment of child benefit is taken fully into account in determining the financial resources available.

1.2 Amount Needed by the Applicants

The reasonable outgoings and commitments of the applicants are assessed. The assessment considers the expenses and out goings which are familiar and accepted items of family expenditure. This is to establish the additional cost to the applicants of caring for the child.


2. Termination of Allowances

Payment of an allowance will be terminated in the following circumstances:

  • Where the child ceases permanently to have a home with the applicants (temporary periods of absence e.g. Respite Care or hospitalisation are not considered)
  • Where the child ceases full-time education and commences employment or qualifies for a placement on a government training scheme
  • Where the child qualifies for Income Support or Unemployment benefits in his/her own right
  • Where the child reaches the age of sixteen
  • Where any predetermined period agreed between Luton Borough Council and the applicants expires
  • The applicants income rises above the level at which a contribution can be considered
  • The residence order is revoked

Once an allowance is terminated in cannot be recommenced.
